India Slaps Samsung With Tax Demand Of $601 Million For Evading Duties On Telecom Imports

Reuters reported on the 25th that Samsung Electronics was ordered to collect taxes and impose fines worth about 900 billion won from the Indian government for avoiding tariffs while importing telecommunications equipment.

According to a Reuters report, India's tax authorities claim that Samsung Electronics misclassified imports to avoid tariffs of 10% or 20% while importing major telecommunications equipment.

The item is a small radio frequency circuit module called 'Remote Radio Head', which is a key component that transmits signals from 4G mobile communication base stations.

Samsung Electronics did not pay tariffs between 2018 and 2021 when it imported 784 million dollars (about 1.1513 trillion won) worth of parts from South Korea and Vietnam.

Samsung Electronics submitted the results of the uation of four experts, saying, "This part does not perform the function of a transceiver, so it is a tariff-free item."

However, the Indian government said in a letter submitted to the government by Samsung Electronics in 2020 that the part was defined as a "transceiver" and claimed that it was an "item subject to tariffs."

In addition, Samsung Electronics' Indian subsidiary executives were fined a total of 81 million dollars (about 118.9 billion won) in connection with the incident.

In response, Samsung Electronics said, "This issue is a matter of interpretation of item classification by customs," adding, "We are complying with Indian law and considering legal action."

Reuters quoted experts as saying, "Samsung will respond legally, but it will not be an easy fight amid an atmosphere in which the Indian government strengthens control over foreign companies," saying the recent tariff controversy in India has become an investment risk for foreign companies.
